Ik heb me weleens laten vertellen dat het in Amerika niet toegestaan is om drank in de auto te vervoeren mits het achter in de kofferbak zit zodat je er zeker niet bij kan tijdens het rijden. Hoe zit dat met een auto die 5 deurs is en dus eigenlijk geen afgesloten kofferbak heeft? THnx.

Drank mag in de auto vervoerd worden maar mag niet open zijn.
Dus een gesloten fles wijn mag naast je staan zolang die maar niet open is.

To comply with TEA-21, a state's motor vehicle open container laws must:
- Prohibit both possession of any open alcoholic beverage container and consumption of any alcoholic beverage;[8]

- Apply to all vehicles on a public highway or the right-of-way (i.e. on the shoulder) of a public highway;[8]
- Require primary enforcement of the law, rather than requiring probable cause that another violation had been committed before allowing enforcement of the open container law.[8]
- Currently, 39 states and the District of Columbia are in compliance.[8] Alaska, Louisiana, Tennessee, and Wyoming have similar limits on the possession of open containers in vehicles, but not to the level of TEA-21 compliance.
- As of November, 2007, only one state (Mississippi) allows drivers to consume alcohol while driving (as long as the driver stays below the 0.08% blood alcohol content limit for drunk driving), and only eight states (Arkansas, Connecticut, Delaware, Mississippi, Missouri, Tennessee, Virginia, and West Virginia) allow passengers to consume alcohol while the vehicle is in motion. Still, local laws in these states may limit open containers in vehicles, although those local laws do not impact the state's compliance or noncompliance with TEA-21.

Volgens mij moet je hier niet spreken van "niet open is", maar van "gesloten zijn zonder dat de verzegeling verbroken is".
Want heb je in de passagiersruimte een fles wijn gesloten met een schroefdop, die al een keer los is gemaakt maar daarna weer dicht is gedraaid, dan ben je in overtreding.

Hier nog wat meer info voor wat betreft het vervoer van alcoholische drank in een auto en dan voor een auto zonder afgesloten kofferbak.

2. Specify the passenger area of any motor vehicle.
The open container law must apply to the passenger area of any motor vehicle. "Passenger area" is defined as the area designed to seat the driver and passengers while the motor vehicle is in operation and any area that is readily accessible to the driver or a passenger while in their seating positions, including the glove compartment. Vehicles without trunks may have an open alcoholic beverage container behind the last upright seat or in an area not normally occupied by the driver or passengers. A law that permits the possession of open alcoholic beverage containers in an unlocked glove compartment, however, will not conform to the requirements. "Motor vehicle" is defined in the regulation to mean a vehicle driven or drawn by mechanical power and manufactured primarily for use on public highways. The term does not include a vehicle operated exclusively on a rail or rails.

3. Apply to all alcoholic beverages.
The open container law must apply to all alcoholic beverages. "Alcoholic beverage" is defined in the regulation to include all types of alcoholic beverages, including beer, wine and distilled spirits. Beer, wine, and distilled spirits are covered by the definition if they contain one-half of one percent or more of alcohol by volume. An "open alcoholic beverage container" is any bottle, can, or other receptacle that contains any amount of alcoholic beverage, and that is open or has a broken seal, or the contents of which are partially removed.

Ik heb ook wel eens iets gelezen over, dat het verboden is om alcoholische drank bij je te hebben, dus ook niet in de (kofferbak van de) auto, binnen de grenzen van de Tribal Lands. De gebieden waar de Indianen wonen.
Ik kan dit niet makkelijk vinden, maar lees hierover iets op de beetje krakkemikkige website (nummering van vraag en antwoord klopt niet, nummers ontbreken) FAQ's About Life on the Navajo Nation, bovenaan:

89. Are alcoholic beverages legal on the Reservation?
Federal Law prohibits the possession, sale or consumption of alcoholic beverages. Restaurants usually stock nonalcoholic brews.

.. What is the penalty for bringing alcohol onto the reservation?
On first offense, the alcohol is usually confiscated or disposed of. Continued offenses result in heavy fines and jail time. The entire Navajo Nation is included by this law. There are no "safe zones".
Everyone living or traveling on the Navajo Nation is included. As a result of a limited number of police officers and the need to address more serious crimes first, prohibition may not be actively enforced in some areas, unless abuse of alcohol becomes evident. Because of this, some non-Navajos have falsely assumed that some housing compounds are exempt from the ban on alcohol. This is not true, though some might wish it. There are no exceptions. Violation of prohibition is a Federal crime. Continued offenses can result in jail time, heavy fines, or loss of the right to visit, live, or work on the Navajo Nation.

Sterker nog: het kan soms zelfs per county verschillen. Als richtlijn is het goed om te beseffen dat in Amerika men over het algemeen wat strenger is dan in NL voor wat betreft alcohol. Neem geen risico en neem het gewoon mee in je kofferbak, dan zit je altijd goed.

Na een restaurantbezoek wilden we het inmiddels lege bierflesje meenemen als souvenier.
We vroegen de waiter of dat in orde was en dat gaf nogal wat onverwachte consternatie met een compleet ingepakte fles als resultaat

Dat is hier ook het geval: als je je fles wijn niet volledig geleegd hebt tijdens het eten, dan mag je de aangebroken fles meenemen, maar alleen als het restaurant de kurk er weer volledig in doet, en de fles vervolgens in een verzegelde plastic zak plaatst.

Dat is niet helemaal correct. Iedere staat heeft een open container law, alleen geldt die van Missouri enkel voor de automobilist en niet voor passagiers (in Virginia is dat ook zo, bijvoorbeeld). Als je dus alleen rijdt en er wordt een open alcoholhoudende fles het passagiersgedeelte van je auto gevonden, ben je ook in Missouri strafbaar.

niet helemaal goed gelezen. Idd, MO en die andere paar staten hebben dus geen open container law voor auto's, maar wel voor de bestuurder. Maar goed, er zijn dus ook steden die wel een open container law hebben voor de auto, zoals Independence.

Nou ik maak me er niet druk over. Bij mij drinkt er niemand alcohol in de auto. Zeker mijn kinderen van 5 en 7 niet.
Dat mag van mij alleen maar thuis.
