i-130 niet meer mogelijk?

Ik was nog een aantal laatste zaken aan het checken om de aanvraag voor M46 in te leveren bij de gemeente.
En toen kwam ik opeens tegen dat de DCF oftewel de i-130 niet meer mogelijk was vanuit NL!!! Maar als ik het goed begrijp betekent dit dat je het niet meer in Amsterdam kunt aanvragen... Maar mijn bijna man haha kan het volgens mij wel inleveren in NYC, op een andere website zag ik weer dat je het bij een huwelijk met een Nederlandse ook in Frankfurt kunt aanvragen ?!?!

Heeft iemand enig idee hoe de situatie er voor staat op het moment?
Wij willen namelijk graag daarheen verhuizen en zijn zus had alle papieren al voor me ingevuld... moet nu allemaal weer overnieuw! grrr...

Nog een vraagje als hij inderdaad de papieren daar moet inleveren is het dan de bedoeling dat ik ook daar ben?? Aangezien nav van het I-130 allerlei onderzoeken zullen zijn (medisch en interview etc), mag ik daar dan blijven zonder ander visum tot de papieren rond zijn???

Ben helemaal in de war door dit nieuws....

Ik had het inderdaad gelezen... Thanks! Maar desondanks worden mijn vragen daar niet echt in beantwoord... ik heb in de tussentijd ook al een mail uitgestuurd naar ImmigrantVisasAms@state.gov. In de hoop dat zij ons meer informatie kunnen verschaffen want op internet is er nog niet veel over te vinden...

I have a question concerning the I-130. My fiancee and I are about to get married in the Netherlands.
My future husband is from NYC and I'm from the Netherlands. We were planning on moving to NYC
with the I-130. Unfortunately we've seen the changes in the processes... But certain things aren't
clear to us:

- Does he have to file the I-130 either in NYC or in Frankfurt?
- The interviews and test following this process will still be done in the Netherlands? Or do we have
to fly up and down to Frankfurt/NYC?
- If filed in NYC am I, by than spouse, allowed to stay in the USA while my papers are in process and
untill the process is done? Or only for short stays? Or not at all?
- May we file the papers by mail or does one of us or both of us have to file it in person?

Please inform us regarding to above mentioned issues.

Ik kreeg zo waar antwoord!!!

Dear Ms. Gwyneth:

Thank you for your inquiry into U.S. immigration and congratulations with your wedding plans. Please ask the civil servant, one you are married, to also prepare an international version of your marriage certificate (uittreksel uit de burgerlijke stand omtrent een huwelijk, document B). You may want to order more than one original. Your then husband, being a resident of the U.S. must file with the United States Citizenship and Immigration Services (USCIS) office having jurisdiction. You will find the appropriate field office through their website http://www.uscis.gov. USCIS can accept petitions by mail. USCIS Frankfurt can only take petitions for us from U.S. citizens with Dutch residence permits. Once filed with, accepted and approved by the USCIS your petition will go overseas through the National Visa Center in Portsmouth, NH. Upon receipt by us of your file we will assist you with your visa application as best we can, probably still within the ten weeks. Travelling to the U.S. prior to immigrant visa issuance is permitted as long as you can demonstrate the immigration official at port of entry that you meet all conditions for travelling without a visa under the Visa Waiver Program. In other words you can visit only. Once you travel to the U.S. with the intention of taking up residence U.S. Law dictates that you must travel with an immigrant visa. Until such time as we can issue you your immigrant visa please do not quit your job, don't sell your house, etc. Your husband will be most welcome to accompany you in due time to the final interview of course, but for the process his presence is not required.

Een M46-verklaring is een advies afgegeven door de Immigratie en Naturalisatiedienst /Vreemdelingenpolitie. Aan de hand van dit advies kan de ambtenaar Burgerzaken beoordelen of er in uw geval sprake is van een schijnhuwelijk. U hebt deze verklaring nodig als u of uw partner niet de Nederlandse nationaliteit hebt en u wilt:

-gaan trouwen
-een geregistreerd partnerschap aangaan of
-uw huwelijk in de Gemeentelijke Basisadministratie (GBA) inschrijven

In praktijk kwam het er onder andere bij ons op neer dat we een keer onaangekondigd bezoek kregen van 2 heren van de vreemdelingenpolitie. Zij kwamen even kijken of we wel echt bij elkaar woonden.
Mijn vrouw en ik woonden toen nl nog in Nederland en zijn daar ook getrouwd.
